Open Records Request Procedures

Pursuant to KRS 61.876, Open Records Request Procedures for receiving records maintained by and in the custody of the Kentucky Department of Fish & Wildlife Resources follow below.

Notes – Please read these before submitting a request:

1. Residency requirement – KRS 61.872(2) provides any resident of the Commonwealth with the right to inspect public records and allows the records custodian to require the applicant to provide a statement in the written application of the manner in which the applicant is a resident of the Commonwealth under KRS 61.870(10)(a) to (f). Please complete the applicable portion of the Open Records Request form for this purpose.
2. Commercial requests - KRS 61.870(4) defines “commercial purpose" as “the direct or indirect use of any part of a public record or records, in any form, for sale, resale, solicitation, rent, or lease of a service, or any use by which the user expects a profit either through commission, salary, or fee." Additionally, per KRS 61.874(4)(b), KDFWR shall require a certified statement from the requester stating the commercial purpose for which the records shall be used. If applicable, please complete and submit this form ( Certification of Commercial Purpose Form ) with your request. However, "commercial purpose" does not include the publication or related use of public records by a newspaper or periodical, by a radio or television station in its news or informational program, or by use in the prosecution or defense of litigation by the parties to such an action or their attorney.

Submitting a request:

To receive applicable records, please complete the Open Records Request form or submit your request in writing, identifying the specific records sought and providing the required residency statement. Please be sure to provide your name, address, and daytime telephone number in the event we need to contact you. Also, indicate whether this is a commercial request. If commercial, please complete and submit the Certification of Commercial Purpose form (linked above). All requests must be signed. If the records you are seeking are in the custody of or maintained by another agency, submit your request directly to the specific agency.
